Seven states, including Texas, have sued over DACA, which prevents the deportation of young illegal immigrants who came to the US as children.
Texas Attorney General Ken Paxton says DACA is unconstitutional because it amounts to immigration law enacted by executive order instead of by Congress.
District Judge Andrew Hanen on Wednesday asked the two sides to submit briefs, which are due on Monday.
