(Austin, TX) — The state of Texas says disabled children are getting the special education services they need despite the limitations of its arbitrary eight-point-five-percent benchmark rate.
Yesterday, the federal government told Texas to prove it, or get rid of the rate and stop punishing school districts that give special education services to “more” than eight-point-five-percent of the student body.
The U.S. Department of Education is ordering Texas to report back in 30 days with proof that every disabled child who wants it can get special education services.
Problems linked to the benchmark rate were first reported last month by the “Houston Chronicle.”
