Texas Attorney General Ken Paxton is pushing a federal court to let the state defund Planned Parenthood.
He told the 5th Circuit Court of Appeals today there is no reason to keep the women’s health group in Texas’ Medicaid program.
He said it can’t be considered a “qualified” provider under federal law.
He also says the court has already decided a district judge applied the wrong legal standard when it issued an injunction in 2017.
Paxton believes the abortion provider will not be irreparably harmed if it does not get Medicaid funds.
There’s no word on when the 5th Circuit could make a decision.
